WHAT IS THE “MODERN MEDIATOR”?

I am Ari Sliffman, mediator and arbitrator, and I recently opened a dispute resolution practice called “AJS Resolutions. I offer mediation and binding arbitration services to Philadelphia, the “Collar Counties,” and South Jersey (and beyond if requested). However, you probably know this considering you are either reading this blog on the AJS Resolutions website (still in construction) or you have seen me post about mediation and dispute resolution on LinkedIn.
AJS Resolutions’ tag line is “Modern Mediation for Modern Litigation.” This quip is simply foreshadowing that beyond my abilities as a mediator, litigation in the “20s” requires a modern approach from dispute resolution professionals as well. Whether that’s using the obvious technological venues of virtual or hybrid mediation, to the not so obvious AI advances assisting dispute resolution professionals.
With the world ever evolving, it’s vital that businesses and lawyers have the best and newest offerings at hand. The Modern Mediator understands how to put those offerings to use in a practical and effective manner, such as using AI in a variety of ways, including to assist in more efficient research to determine values from similar cases and gather information on involved parties and the relevant damages at hand. At the same time, the Modern Mediator will know the limitations AI presents, including the internal biases AI has that could affect our own knowledge base and beliefs.
Moreover, the Modern Mediator is also someone who has the soft skills 21st century clients need. Most individuals are more in tune with their internal struggles than they ever have been thanks to normalizing mental health. The ability of the Modern Mediator to connect with the client through a personal level when necessary will permit trust to build in the process and higher likelihood of success of that client believing in the mediation process.
